Piotr Ilytich Tchaikovsky’s “1812” Essay

Composed by internationally-known classical musician, Piotr Ilytch Tchaikovsky, the classical music piece â€Å"1812 Overture in E Flat Major, Op. 49†, reflects the French invasion in Russia which was never victorious. With its full title, â€Å"The Year 1812,† Op. 49; French Ouverture Solonelle), the classical music also implies the withdrawal of Napoleon in 1812 during the Napoleonic Wars.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The musical elements in the composition display some underlying themes which made it more interesting: tone, rhythm, harmony, and form.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The tone uniquely displayed the varying pitch all through out the musical piece. This is manifested by the high pitch and low pitch that could be observed in the piece. The combination of the different pitches made the musical piece interesting to listen to.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Meanwhile, another interesting about the musical elements present in the composition is its rhythm. Tchaikovsky used unique sound representations in the composition, some of which are the horns and the firing of the cannons.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Another musical element is harmony. Despite the different pitches and rhythm present in the piece, the harmony of the musical notes and instruments that are used appear to be in agreement with each other; no â€Å"out-of-place† tunes could be observed, I think.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Lastly, the form of the musical piece is also worth noting. The form which tells about the over-all structure of the musical composition is also outstanding. The combination of the musical notes, tempo, tone, and the other elements came out smoothly.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   In addition, the 1812 Overture became known for its â€Å"real cannon fire† effects when it is performed live in outdoor events. Meanwhile, if the performance has to be done indoor, the orchestras use sounds representing the cannon fire through computer-generated sounds. Tchaikovsky entered the St. Petersburg Conservatory where he realized his true calling in the field of music. After some years, he later moved to another conservatory where he met a group of Russian composers. Those Russians were known to be nationalist which somewhat inspired Tchaikovsky in his second symphony entitled, The Little Russian. Being known as not sufficiently Russian and â€Å"cosmopolitan,† he was later rejected by this group. In 1880, Nicholas Rubenstein, Peter Illych Tchaikovsky’s mentor, suggested to Peter that a striking celebratory piece should be composed for festivities. The piece was to be presented in the square near the cathedral, with the accompaniment of a magnificent orchestra, cathedral bells and live cannon fire to attain the exactness stipulated by the musical score in which every shot was written exclusively (Lampson, 1999). The Fugitive Slave Act is one of the causes of the Civil War in America. The Fugitive Slave Act is an act that renders all slaves to be controlled and overpowered by their owners with the help of District Court of the United States. However, the owners have a big responsibility towards their slaves especially when it is fugitive for they need to pay to the District Court of the United States when an officer or a marshal captured a fugitive. When it happens, the owner needs to go to the District Court and have all the papers needed to show that the fugitive was his of theirs. In this case, it will be a big burden for the owners to have fugitives so they find their fugitives on their own before the officers or the marshals could find them because it will cost them a lot of money, time and effort. The purpose of this paper is to show the relation of the Fugitive Slave Act to the life of Margaret Garner during the years of slavery.Margaret Garner is a fugitive slave who has four children. She and her family went to a friend in order to escape from their owners. They went through a lot of place to find the house of their friend named Kite. However, before they saw the house of their friend, they asked different people to give them the direction going to the Mill Creek, the place of the house of their friend. Through this journey, many people have seen them so their pursuance can reach them whenever they go.When they were in the house of their friend, their pursuance finds them but before they got Margaret Garner, she killed her youngest daughter, who was also her favorite child. She also likes to kill all her three children but her pursuance got her and brought her to the court. Margaret Garner thought of this situation as the only way not to make her children felt the suffering of being slaves. The court let Garner and her family free because the evidences showed that they were given a vacation by their owners in a Free State. Therefore, they were free during the ti me when they went to the house of their friend, but going to the Mill Creek, which is a purpose of escape brought them back to slavery. Both slaves and free backs in America were affected with this Act because this law made a big transformation to the ownership of the slaves, not only the slaves who are being controlled in this Act but also the owners. In the Fugitive Slave Act, when a slave escaped from his or her owner, there will be a lot of discussion between the owner and the District Court in terms of record verification, and penalty of the owner because of its fugitive slaves. Therefore, the owner will be the one who is responsible in finding its slaves to avoid penalty. Aside from the owner’s problem to its labor force, there will be also a problem when their fugitive slaves were captured by the officers or marshals and brought to District Court. The Northern abolitionist and Southern slaveholders were also affected with this Fugitive Slave Act because it produced a sch eme of reward in order to assist the generation of enticements among Southern slaveholder and Northern abolitionist catchers in regaining their possessions. Consequently, escaped slaves will not be safe in the North. Therefore, slaves have limited actions in their works for they were not safe in every place they go.According to the Section 10 of the Fugitive Slave Act, when any person held to service or labor in any State or Territory, or in the District of Columbia, shall escape. There from, the party to whom such service or labor shall be due, his,   her, or their agent or attorney, may apply to any court of record   therein, or judge thereof in vacation, and make satisfactory proof to such court, or judge in vacation, of the escape aforesaid, and that the   person escaping owed service or labor to such party. This statement brought the case of Margaret Garner to the court. According to the evidences, she had her vacation to the Free State during the time she went to the Mill Creek. That is why the court made a decision to set her and her family free because her owners did not abide the law that she can go to the Free States when she was in a vacation. However, the means of killing her daughter for the notion of not making them slaves when they grow up is a form of escape. In this case, they were called fugitives. Therefore, they were brought back into slavery.During the year of 1850’s when slavery became intensifying problem of both North and South due to the Fugitive Slave Act and their slaves, owners became stricter and wanted their slaves to be barricaded inside their properties so that these slaves would not escape. Margaret Garner’s tragic story happened during these years, when slaves do not know what to do in order to make their family free even if the pay for this cost was their slavery until they die because of the pain, sorrow, and struggle of being slaves.Margaret killed her daughter to make a change. She knew that it was not j ust for her and for her family but also for the society. She wanted change – a change in the way of treating slaves. The law can be seen as â€Å"unjust law† because the individuality of the slaves was taken for granted. The Fugitive Slave Act was all about the actions that can be done to the owners and the fugitives when the fugitive is captured. However, the fugitive has no right to have its life. Slaves were treated as robots and animals, which are actually humans. The tragic story of Margaret Garner is a revelation to the law and to the whole society during this period – the â€Å"unjust law† made the slaves not humans but animals taking them as their own.Sources:Halsall, Paul. Foreign Policy of United States Essay Example | Topics and Well Written Essays - 1500 words

Foreign Policy of United States - Essay Example During this time, among other things was the settling of the West and the Indian Wars. The United States signed the Treaty of Guadalupe de Hidalgo in 1848 which gave the Southwestern lands to the United States. This began the migration west and the Indian Wars began. This time was marked by much sadness and death. Most of the western lands belonged to different Indian tribes. All of those tribes depended on their hunting grounds to survive. There was much to lose in the loss of their lands. Life would disappear as they knew it. As the white man continued to move into the area, with them came buffalo hunters and white ranchers. These people killed buffalo by the millions just to get their pelts and trampled the land. The people began to starve and there was no way to feed the women and children of the tribes. The government established treaties with most of the tribes giving them rations of food and clothing to allow pioneers to pass through their lands. Most of these pioneers came with the thoughts that the only good Indian is a dead Indian. The Indians land was taken from them and they continued to be forced onto to reservations that were on land that was mostly worthless. They could not hunt and the land would not support stock or farming. Even those that fought back like Sitting Bull and Red Cloud were eventually defeated. The Trail of Tears which was the removal of five Tribes from Southeast Oklahoma Cherokees were marched to a reservation. The march killed most of the old people and many of the women and children. It was a loss that the Cherokee and most of the white people of today will never let be forgotten but was only one example of the many cruelties that these People withstood. The Battle at Wounded Knee is another. In this case essentially a whole tribe was shot dead in camp. It is hard to see it as a Battle, as it seems it was pretty one sided. 1914-1919 Woodrow Wilson who was known as the President of the people was President at this time. He was the idealistic President and up until the time we entered World War I, the country was isolationist in values. Wilson changed many things in this country during that time. He believed that government should be for the common people and during his first term he helped farmers with the Federal Farm Loan Act and the Warehouse Act. The Farm Loan Act allowed low interest loans available to farmers and the Warehouse Act authorized them to have security loans on staple crops. Social welfare programs were started. Workman's compensation began to protect workers and the Child Labor Act began. The Child Labor Act only allowed products produced by children 14 or older to be sold. He followed that with the Adamson Act which only allowed children to work an 8 hour day. The Underwood Act established the first income tax and that was felled by the Federal Reserve Act. All of these things happened because of Wilson's idealist attitude (Ferrell, 2001). Unfortunately the idealistic attitude that helped the country so much also led to it entering World War I. Some say that Wilson had it in mind from the very beginning to enter the war and others say it was because of his pride (Hoover, 2009). We will probably never know the answer to that. Whatever

Are Social Networking Cites a Gateway to Infidelity Research Paper

Social networking websites have had a long history in our society but the period at which it made its breakthrough was in the twenty first century specifically in 2004. The main reason for invention of these sites was to bring people together; they can be either close friends or strangers who have common interests. The internet does not restrict one to communicating to his specific friends but rather have a chance to meet new people and create new relationships. Face book is one of the most popular website all over the world; most people have embraced this social networking in facilitating communication. It is no wonder that some have even adopted it ii carrying out businesses. This is made possible by carrying out advertisements, the reason why most business people adopt this website is the population that uses face book, and business people understand that they are able to get their target market through face book. Apart from face book, there are other social networks that have greatly affected peoples life’s, they include, MySpace, black planet, linked in, twitter and Habbo. Popularity of each website is influenced by factors like race, ethnic and nationality (Buss, 2000 ). As much as the internet has contributed to far-reaching advantages to an individual, other factors have affected negatively to the well being of the society. According to research levels of infidelity are becoming rampant, a factor that has been promoted by social networking. Internet leads to easy access of different individuals of different sexes. The reason to why this has been made possible is the capability of sharing instant messages between different parties by use of emails. Due to this, most marriages have broken leaving most couples single (McKenry, 2009). Different social network websites have different features that have facilitated easy communication between differ ent individuals. It is easy to choose what gender to communicate to due to availability of one’s profile outlining all details about a person. MySpace for example, allows one to view one profile, which include a photograph. These sites have posed a challenge to most marriages in the sense that, most married men and women participate in flirting using different social networks. Some do not uphold the values of marriage nor societal requirements on marriage but rather, have their own egocentric interests they would like to fulfill. When some couples are faced with challenges in marriage, they choose to seek solace from social networking website. A woman who does not have a voice in her marriage for example, may choose to use the internet as a way of seeking recognition and appreciation from other men, something she does receive from her husband (Harvey, 2006). THE NEW AGE OF CHEATING: ONLINE INFIDELITY Emergence of computers is one of the reasons to why internet access has beco me worldwide. After fixing, the section was then transferred to a Petri dish containing distilled water where it was rinsed for approximately 2 minutes. After rinsing, the root tip section was then placed inside a bijou bottle containing 1 ml of 1M HCl and incubated at about 60ï‚ °C for about 5 minutes. The contents of the tube were then poured into a Petri dish and the root tip carefully picked out using forceps and transferred into another Bijou bottle containing aceto-orcein which was then left in a dark chamber for about 10 minutes. The bottle was then removed from the chamber and the root tip carefully removed using forceps and placed on a slide on which a drop of 45% acetic acid had been placed, this was then covered with a cover slip. By this time the root tip section was already well softened and stained; the tip was then squashed by slightly tapping on the cover slip with a pencil until it was evenly spread out under the cover slip as a pink mass. The glass slide with the root tip ready for observation on the microscope was then transferred to a light microscope and viewed at x400 magnification strength. Photographs of the cells undergoing mitosis were then taken and drawings made of the various stages of mitosis. It was observed in the experiment that the cell division process assumed all the four stages shown in the images above and that the staining clearly revealed the features of all the four stages it takes for a cell

Analysis of a real life rhetorical situation Essay

Analysis of a real life rhetorical situation - Essay Example She also pointed out that the baby just needed supervision while playing with her toys making sure that the baby would not put anything in her mouth and would not be climbing furniture. She further reasoned that the baby was also easy to entertain with her blocks and her other toys. I was concerned about watching the baby because I had little experience watching over babies. I did not know how to change a diaper, nor did I know how to feed the baby her formula. I also did not know what to do in case the baby cried. My friend further reassured me that she just changed the baby’s diaper and she also just fed the baby so the baby would not need any changing or feeding in the next two hours. And by then, my friend said she would already be back from her errand. This rhetorical situation that I found myself in mainly involves my friend and her intention or goal to get me to watch her baby for about an hour. Her attitude is earnest as she is posing her request; she is worried about leaving her baby, but she knows she cannot take her baby with her. My friend is a full-time mother and has been married for 3 years now to a sales representative for a pharmaceutical company. Her extended family lives in another state and she and her husband moved in next-door about a year ago. She has credibility in her words and her actions because I could see she is distraught and worried about not having enough milk to feed her baby, but she is also concerned enough about my capabilities in caring for her baby. She takes the time to instruct me on what to do and what not to do while caring for the child. As an audience to this rhetorical situation, I am a student who is currently staying, for the weekend, at my parent’s house. My parents are away for th e weekend and I am alone in our house. I have had little experience caring for children as I am an only child and single. I am reasonably convinced that I would be able to watch the baby for about an

Aeronautic Science & Aerodynamics Essay Example | Topics and Well Written Essays - 750 words

Aeronautic Science & Aerodynamics - Essay Example The aerodynamics component of the wind on the tall buildings would be necessary to decide on the type of shape and orientation of the structure. The detailed aerodynamic analysis would be necessary not only for its design but also for the selection of materials for construction and also the construction technology. As a practice, model of the building would be initially tested for its behavior under different environmental conditions in the wind tunnels before arriving on the final form. The role of HVAC systems in ensuring the required comfort inside the functional space of any building is well known. The operation of these systems demand large amount of energy and also consumes considerable amount of expenditure for their operation. Hence, in an effort to minimize the energy use in the building units, it is essential that the renewable systems are given the priority. Maximising the adoption of the natural methods of ensuring the ventilation in the building would bring considerable saving in the consumption of energy. But effective implementation of the natural means of ventilation like passive cooling systems required extensive information on the natural air flow pattern prevailing in that region. Also, the air movement inside the building units can be directed appropriately configuring the enclosures and also placing the opening at suitable locations. The aerodynamics inside the buildings would be governed most by the wind velocity, the size of the openings , the heating –cooling rates of the building and also the indoor environment prevailing. In addition, the external environmental conditions like neighborhood buildings and natural vegetation too need to be considered here. The aerodynamic situation around all buildings are turbulent and three dimensional. The air flow patter around the building would change subject to any new constructed building

Hazardous Waste Incinerator - Essay Example However, it will be worth it because the environment will be safe for future generations. Annual cost of the household hazardous incinerator = Running costs + Salaries + Insurance costs = Construction costs / 15 years (Dividing the construction cost by 15 years, allows the estimation an annual cost of the incinerator over the 15 year period) Although the hazardous incinerator costs $ 389,667 annually, the community’s incinerator is useful to the environment. It prevents the unfortunate occurrences of the 20th century in the United States. Municipal councils are often unable to achieve proper and safe disposal of refuse. As a result, issues like the Mobro incident of 1987 occur (Worell& Vesilind, 2012). However, a household incinerator for the community ensures that solid waste does not contribute to environmental pollution or the municipals burden. Finally, the incinerator will be useful for around five years. This means that the community will have an opportunity to upgrade the incinerator’s technology to be able to process solid waste products more safely. This is because environmental technology is fast developing to satisfy the environments

Desire to be protected Justified Hasselstrom to get a gun; however, she considered other means of protection first. To begin with, Hasselstrom used improvised means for protection. For example, she had her own gun (spray cans of deodorant) which did not have to be registered. However, one night while camping, the author and her friend, harassed by two young men, decided not to tempt fate and use their improvised mace, but simply leave the camping area. When improvised means of protection did not work, Hasselstrom onsidered another option- a citizens band radio, a system of short-distance radio communications between individuals which does not require a license. However, she rejected this method of protection providing an example of a woman who got beaten and raped using a CB radio to get help with a flat tire. The last method Hasselstrom considered as a mean of protection was self-defense. For her, kung fu class was a smart decision because on the top of her self-preservation, her height and weight did not give her any benefit. Therefore, looking for protection, Hasselstrom provided the eaders with Justified steps she took prior to the extreme measure of protection- a Also, the author was well-grounded for her need of a gun because she gun. wanted safety. Firstly, she did not feel safe on her land. While Hasselstrom lived on a ranch in secluded area 25 miles from the nearest town, she, somehow, managed to have uninvited guests on her property. For example, one day she noticed an armed man on her land who wanted to shoot ducks. As a result, she could not feel safe even on her territory. Secondly, as the author was vulnerable even while driving her car, her possession of a gun was reasonable. Hasselstrom provides the readers with examples to prove her right. In one of the examples, an unknown car was following her on her way home, and made her stop by flashing a blinding spotlight in her face. Another example depicts a man who was playing cat-and-mouse with Hasselstrom within 30 miles when she was driving in a desolate part of Wyoming. Thirdly, the fact that Hasselstrom did not feel safe even in public places Justified her to own a gun. She provided an example of her and her friend being harassed and scared by men while camping in the West. Moreover, looking for some help from the local rangers, he had to face with their carelessness and unwillingness to protect and help. In addition to Hasselstroms desire of protection and safety, there is a desire of peace she was looking for which Justified her to possess a weapon. First of all, she could not get a peace ot mind being harassed on a daily basis. Whether sne was among people or on her property, she faced acts of harassment or danger which took her further away from a peace she was searching for. Then, she could not find a peace of mind if she was constantly stressed out, suspicious and scared about everything. One day the author found deep tire ruts in her yard and garbage in her driveway. More likely, that fact would lead a person like her to suspect that someone unfriendly had an intention to hurt or do her harm. Third of all, Hasselstrom lived in the environment where women did not stand much for a chance of not being harassed. Men in her area worried her, and their harassment would not stop until stronger measures were taken. However, Hasselstrom did not want to be either daily harassed, be another victim of rape or permanently stressed out and scared. Threfore, she believed that having a gun handy would lead her to a peace of mind she was looking for. In conclusion, relying on Hasselstroms examples provided in the article, she was Justified for her need to own a gun. She had no choice but to use it in dangerous situations to protect herself. When used responsibly, women in the same situation as the author would live protected, safe and with peace of mind they desire. What Hasselstroms message was in this article is that no one, man or woman, should live in fear. And in her situation, owning a gun gave her that security.

Adventure Or Just Another Holiday Tourism Essay Adventure or just another Holiday? Holidays these days are not a luxury. They are a necessity. Every year people wait for that time of the year when they can shut off their laptops and head off to a place where they can forget about appointments and deadlines. The more people work the more is their need to get away from it all. Owing to lesser and lesser time people have on hand, holidays are a way to be together with families.   Ã‚   Recently the recession has brought about changes in the way people travel. Recession has created a new set of travelers called flashpackers. They are actually backpackers who are on a budget trip who do not share their sleeping space but opt for private rooms. People mostly these days go for all inclusive holidays which are a great help. They let you help your budget yourself; let you keep a check on your food, drink, entertainment and accommodation. The question is with little time on hand and lots of holiday agencies out there to lure you what would you go for? A general myth about adventure travel is that it is full of risks and not everyone can do it. This draws a lot of people away including families. Role of Tourism in Economic Development

Role of Tourism in Economic Development All sectors of the economy play an important role in making a stable and long running development. Tourism is one of the sectors which plays an important role in development and also generates foreign revenues. This sector is peaceful and reflects the nature and beauty of the country. It helps people of far flung areas to promote their culture and norms, it also provide opportunity to country to make a better image around the world. There are many issues this sector is facing nowadays and the popularity of this sector is sliding down day by day means that people is not ready to make tours because of many problems and threats to security and life. Several studies and researches have been conducted on this tourism and its relation to development of economy and also that how can we promote this sector? How can we create better image to world and also what measures we can use to maximize the development? Michael Hitchcock (2004) had explained that tourism and culture have a deep relation. Culture is based on originality, authority, authenticity and many more. Tourists are attracted by such types of factors, he says that invest and reinvest is not modernization and its the human culture that remain there for a long time. Tradition is invested and process goes on its known as constructivist. Cultural transmission is not an authentic option, reproduction is not renew it have its own originality. We should make a clear difference in between the reproduction and originality. In order to save the cultural heritage and to attract tourists he says that culture should bi neat and original. Mohamed Tangi (1977) had conducted a research that Mediterranean handles one-third of world tourism that has damaged the environment of that region due to many factors. He says that Greece, Spain, Cyprus these countries are visited more and the environment is quite hurt for dense tourism to these areas. The natural sites are reduced due to excessive construction for tourists and visitors. Tourism and environment are two parallels that move together, tourism mainly depends on environment along other factors, world is facing huge and fast rising in pollution as more tourism is rising in world. Environment can be man-made, natural or cultural in nature, all have effects on tourism and vice versa, cultural environment includes art, religion and human relations, which can be effected or disturbed by tourism. The countries which are rich in these factors can attract more tourists to their region; tourists may introduce new ways or styles to the places, which can be waste or injurious to th e visited destination. He explained few alternative strategies or development policies to promote tourism to the region. It includes the land use planning, expand and construct islands, holidays and pricing policy, facilities to tourists, anti-pollution and policies, training and information to locals, rules and codes of conduct. Using these and promoting these strategies country can raise its tourism level and also promote development in the region. Tourism will be based on co-operation and planning in the future world, united nation environmental program and world tourism organization both are working and have to play an active role in tourism promotion and protection. Barry Liddle (1989) had explained that tourism is helpful for local government to have a better economy and development. Presently it is the leading sector of the world and it will be stronger in future. Tourism can be of many types i.e. for leisure, work and business or for any purpose. Here industrial tourism is important type of tourism that can generate much information and knowledge. It further has an option that modern industrial tourism means that companies choose a day and at that day they arrange a proper tour to their company or exhibition. They also provide the full tourists facilities to visitors, so to make them feel comfortable. The industrial tours can be updated to local and national level to boost the economy, audit, local, central government and different councils should step in to make this type of tourism better and popular. Erik Cohen (1984) had made a research that there are not much empirical studies in tourism economy, so this is required as we are moving into new and fast world. There are four main principles in tourism i.e. tourist that based upon his motivations, attitudes, role and reaction in response to others actions, the ideas, thinking and relationship of the locals and tourist matters in this sector, the structure and infrastructure of tourism system is an important part that can help it to flourish, the better the system the better will be the outcomes and economic and social impact from tourism to visited destinations. Tourism is based on culture that helps this industry to develop and become a helping hand to economy. More empirical study is needed to merge it with theory and provide world more information about this sector in a systematic way. Amanda Stonza (2001) has explained in the article that tourism is mainly divided into two parts i.e. origins of tourism and impacts of tourism and the main problem is that tourism origins is only concerned with tourists and foreigners, while the impacts are only related to local public. The two halves provide different meaning and together they also only provide partial meanings not full, so origins of tourism should include the local public that how they can attract tourists? How they can promote the tourism in their region? Same is the case with the impacts of tourism; it should include the tourists who are willing to visit the particular places in world. What are the changes that have occurred in tourist after the trip? Origins and impacts both should be positive then the countrys social, cultural and economical conditions will be develop and their tourism sector will grow in a positive manner. Janette Deacon (2006) explains tourism as an important sector of economy and also throws light on not so important type of tourism i.e. rock art conversation. This type of tourism is known as cultural or heritage tourism, cultural or heritage sites are main reasons behind the tourism in most Asian nations like China, India, Pakistan and SriLanka. Rock art conversation is famous in African nations, this tourism is in Africa but its not on large scale. Many ways are discussed to promote rock art conversation tourism so we can save it for vanishing from world. Factors that promote all types of tourism including this rock art conversation is training, skills, education guidelines, security, interests, attractions and many more. These factors will help tourism economy to expand that can create a better image of countrys tourism sector around the globe. International council on monuments and sites and international cultural tourism charter are two major sources to save and promote rock art conversation in tourism sector. Agha Iqrar Haroon (2002) had explained that sustainable tourism can be achieved by working together with the local public sites that can be visited. Ecotourism in Pakistan is not working in a proper manner and Pakistan is not even near to sustainable tourism. In the northern areas 70% of economy is in hands of big businessmen that belong to other provinces and only 30% are in hands of local public. This local public has to survive on daily basis wages and all this is due to big businessmen have share of 70% from revenues and they also have support of tourism companies and government either local or federal. Local public is ignored in framing the policies and sharing the generated revenues, the big businessmen can provide imported facilities to foreigners that the locals are failed to do so. These acts have a negative impact on the employment and on living and earnings of local public of those northerner areas, so government should take few daring steps to save the public from exploit ation from these wealthy investors. Government can invest in these areas, can ensure participation , secure future of local public, share more revenues to locals, heavy tax should be imposed on wealthy businessmen, irrelevant construction should be discouraged, local goods should be used that will generate profits and employment in region, training and guidance to public of concerned area. By doing all these actions our northern areas can be a top place to visit and Pakistan can achieve a sustainable and healthy development in tourism sector. Dean Maccannell (2002) says that tourism is faster growing sector and it has relations to the non-economic factors. Ego factor counts a lot in tourism that personal behavior about tourism and travel, tourism is dependent on the classical and touristy experimental commodity. Ownership and attraction are non-economic factors in tourism or travel, tourism can promote opportunity, preservation and care of cultural heritage will promote tourism and theses are the main factors along the other factors that help to make a stable growth in this fast expanding sector. In short the human ego and the attractions to tourist sites are important factor for development of tourism economy of any country. Yoel Mansfeld (1994) conducted a survey on the tourism in Middle East and what are the major factors that have reduced the tourism to the region of world? In 1980s average growth rate of world for tourism is 6.2% and for Middle East it is 5.9% approx. Turkey and Greece also suffers from the conflict in Middle East between Israel and Palestine. Author also explains that international tourism is main source for developing countries to generate revenues, boost economy, creates jobs and much more. All these things will help them develop and achieve stability. Security situation has a huge impact on tourism around the globe and especially in Middle East that how much Israel suffered? How much other Arab and non-Arab nations have to face decline in their tourism? War or conflict between the Arabs and Israel is major threat to tourism in Middle East. Spill over effects are major in world tourism that if one country suffers from security threats her neighbor will also have to face the conseq uences being a neighbor. Spill over effects will determine their market strategies it means that how well you handle the pressure which is upon you due to disturbance in your neighbor country to save tourism industry of your country? Nowadays terrorism is main threat to world and especially in Middle East as the war is on in that region. So world have to sit together to find a safe and easy solution to this security threats and terrorism to save the tourism industry. Peter Murphy et al. (1989) along with his partner conducted a research that tourism is indirectly related to natural disasters, but this combination is rarely seen in world. Recently the two such cases are occurred one at Mount St. Helen eruptions in 1980 and the second is East Kootenay forest fires in 1985. These two areas are hit by natural calamity and that also effects the tourism ratio in these regions. In first case 30% decline is showed and in second case millions of dollars loss is shown. Along the natural calamity the man-made disasters also are common in world i.e. terrorism and other security threats to world tourism, the event of hijacking of Achille Lauro in 1985 have effected the tourism in Mediterranean region. Disaster planning have for main stages i.e. assessment, warning, impact and recovery, impact and recovery are two main stages that have more effects on tourism. Media coverage plays an important role that how media will post image to world? If the coverage is po sitive then recovery will be faster and if the coverage is negative then problem grows double and tourism will be badly disturbed. So nation should always be prepare for disasters and disaster management authorities should be at standby to handle the problem and also can save tourism industry. Eric Neumayer (2004) used the fix effects panel estimators and dynamic generalized method in this research on small sample size of countries to find the effects of tourism. His main focus is on political violence and other acts that can effect the tourism economy. Tourists always look and prefer the safe sites for tour and they are not ready to take risk for enjoyment. Democratic regimes are more successful in handling the violence pressure and autocratic regimes are not able to cope with the violence that can harm tourism sector. Hall (2004) says that political stability and safety are prerequisites for a healthy tourism in country, the world faced a downstream in tourism economy since 2000-01 and developing countries are more effected, whereas Europe and U.S.A is still the most visited place in world. Terrorism in Greece, Turkey and conflict in between Egypt, Israel, Lebanon and others have a negative impact on tourism. Other nations of the region is also effected by the disturbanc e in region, they are facing a decline in tourism sector. As told above that developing nations are more hurt from this political violence and security threats to tourism sector, it took them years to correct their image in front of world. Huge loss in foreign revenues and decline in their gross domestic product is hurting them badly. So few steps are requires to save this peaceful sector from violence and disturbance. Dinah Payne et al. (1996) creates an ethical model for tourism industry that it is the largest and fastest growing industry in the world; it contributes much to GDP of country. Local community and environment is mostly kept outside from planning and management around the world. Local public should be included in the decision making and then it will helpful to all other factors in the tourism industry i.e. justice, integrity, competence and utility are the four main pillars that can help to create codes of ethics. Ethics is required in tourism sector to make it move at smooth pace and this is basic factor that is helpful in tourism. Research shows the absence of ethics from the tourism industry, environment, community tourists and employees are the main factors that are required to enhance them more in tourism sector. The more will be the ethics the more will be the public and tourists interaction. Few suggestions are that local public should not be ignored, they should be more hospit able to tourists, they must save environment from destruction and list goes on. Codes should be followed in nice manner and that will be beneficial for the public and to tourism sector of country. So this ethics is much needed factor today in tourism industry to make it more attractive and peaceful.

Vincent Van Gogh Essay -- Art, Painting, Yelow House

In the summer of 1881 Vincent Van Gogh asked for his cousin’s hand in marriage and was turned down. He was very insistent on seeing her and took action on this by holding his hand in a flame and holding up the words â€Å"Let me see her for as long as I can keep my hand in the flame† (Wikipedia, Letter 193 from Vincent to Theo, The Hague, May 14, 1882). In 1885 Vincent’s father died (ArtBook: Van Gogh; A profound and tormented genius—his life in paintings, 1998). In December of 1888, Vincent Van Gogh had been living with a fellow artist and friend, Paul Gauguin. They lived in â€Å"Yellow House†; the house that Vincent rented and had painted a picture of in September of that year. On the December 23, Van Gogh approached Gauguin with a razor blade and then left Yellow House in a panic and fled to a local brothel. This led Vincent to cut off part of his ear, which he then gave to a prostitute (Wikipedia, Rita Wildegans, 2007). Vincent spent 3 days unconscious in the hospital after that night and was released back home on January 7, 1889 (Jen Green, 2002). In January and February Vincent was at the hospital a lot due to his hallucinations and paranoia. He thought that someone had poisoned him. In March the police closed down his house after a petition was signed by some of the locals and then was admitted into the town hospital in Arles (New World Encyclopedia, 2008). Vincent reported once to his brother Theo that looking at his face in a mirror calmed him. In April, Vincent’s brother Theo got married and Vincent started to feel like a burden on him (Jen Green, 2002). In May 1889, Vincent agreed to go back into hospitalization at the Saint-Remy asylum. He reported during his stay there that painting soothed and healed his spir... ...know the way he was feeling at any point in his life. I don’t know that there were a lot of psychiatrists and therapists around during his time but while researching him, it seemed like he was in touch with at least two doctors in his life that helped him with his psychological issues. So if Vincent Van Gogh were alive today I would still have him talk to doctors or one psychiatrist that he is comfortable with. I don’t know what kinds of treatments were available for someone in the late 1800’s but today I would see if Vincent was interested in taking a combination of mood stabilizers with antidepressants to help his manic episodes and his depressive ones. The textbook says that using these in combination with each other also may â€Å"reduce the risk of future depressive episodes, just as they seem to prevent the return of manic episodes† (Comer, 2011 p. 224).

An Autobiography: Lee Iacocca Essay -- Book Reviews

1. Title: Iacocca, An Autobiography. 2. Author: Lee Iacocca with William Novak. 3. This book is an Autobiography. 4. Publisher: Bantam Books  ® 5. Copyright  © July 1986 6. Pages: 357 7. Historical Background: His name when he was born was Lido, not really Lee. He changed it when he had to go down South for a sales campaign. He thought that the Southerners would like it better if his name was Lee. It worked fairly well too. Anyway, his father was the first person to arrive in America. He arrived in 1902, at the age of 12. His father went back to his birthplace, Italy, and married Antoinette. They came back across the Atlantic. Except this time, his father, Nicola, was an American citizen. They moved to Allentown, Pennsylvania, also where Lee was born and raised. Lee (Lido, I’ll use Lee from now on though.) was born on October 15, 1924. Lee’s father was a sort of philosophical type of person. He always had an important lesson to tell his son. It usually was great advice that just about anyone and everyone could use. His father once said that ‘When times are tough, be in the food business. No matter how tough times get, people still have to eat.à ¢â‚¬â„¢ He was right. He had a hot dog food stand that stayed afloat during all of the depression. Lee was in the Allentown public schools, as a kid. He was an Italian kid in a place full of ‘Pennsylvania Dutch.’ So he was harassed by a lot of kids. He never let it get him down though. His father was always pushing him to be the best. His father was a hard worker and came from a foreign family. Back then, most parents that came from a foreign country always seemed to push their kids to do their best so they can have a better life style than their parents. Lee ended up going to Lehigh for college. He did very well for himself. Before he went to college though, he enlisted in the army. It was around World War II when he did so, of course. But because he had Rheumatic fever when he was a kid , he couldn’t go and fight. The doctors said it was gone. The army said it could come back though. So they rejected his application. He went to Lehigh instead. Ford always took the top student out of the top fifty colleges back then, for a study at Ford. They would get to work at Ford doing just about everything you could do. Lee was one of them invited. He enrolled at Princeton after that. He graduated with a degree in engi... ...no matter what. He thought that spending time with family was far more important than anything else. It’s a good thing to have values like that. He’s an honest hard working man that deserved all the good things he got. He didn’t fold when it looked hopeless at Chrysler, he did everything he could to keep the company alive, and now it’s having more success than it ever has in it’s history of existence. This is a very good book, and I recommend that everyone read this one. It’s got a lot of interesting stuff and advice in it. It also gives great insight into the auto manufacturing business. There are a lot of stereotype’s out there that say a car company tried to kill them. But really, all of the guys that make the cars are driving them themselves. They don’t purposely make bad cars, they drive them and so do their kids, and I don’t think all of them are suicidal maniacs either. I think most of them are sane people. I s ay one thing we need less of in America is blood sucking lawyers. They’re just greedy people that we could do without some of them. I learned that in order to succeed, you must not give up easily. You can’t give up on your dreams until you have put your all into it.

Rain- Directed by Christine Jeffs Essay

A child’s life has many milestones such as learning to walk, learning to talk and their first day at school. Throughout all these stages parents are obliged to provide guidance, safety and support for their children as they learn to interpreate the world for themselves. Christine Jeffs’ visual text, Rain explores the story of thirteen year old, Janey whose parents are so caught up in self-absorption, they neglect their parental roles to both Janey and her younger brother Jim.This up-bringing of Janey and Jim leave the audience pondering, Does the abandonment of morale parents roles shape a childs transition into adolescence? The consequences of neglecting Janey through her first steps into womanhood, ricochet on Janey’s parents, and damage her perception of the adult world eternally. From the viewer’s first introduction to Janey, a high angle shot of her floating in a starfish position, gives us a deceitful impression about this seemingly, normal carefree life of a young teenage girl. The typical sunny scenery, clear blue water and weatherboard batches sets Christine Jeffs viewers to believe that Janey is surrounded by family life and fun, sharing barbeques and summer swims at their beloved family batch. Christine Jeffs has deliberately juxta-positioned this with a shot of Janey and her mum swimming, however her mum is holding a glass of alcohol. Janey’s mother lets go of the glass, and as it begins to sink to the sea floor, a low angle shot shows Janey diving after it. This immediately leaves the viewer confused about the role model Janey is following, would a normal family allow their thirteen year old daughter to frantically chase a glass of alcohol, or would they be more concerned for their daughter’s safety in deep water? This initial establishment of Janey and her mother’s relationship reveal to the viewers that Janey is growing up under the influence of an irresponsible parent who fails to teach suitable p riorities to her young daughter. Janey is being led to believe that alcohol is desirable and should be prioritized even if detrimental obstacles are to be faced. This acceptation of alcohol becoming an idolized part of adolescence and womanhood reveal to Jeff’s audience that the inappropriate role model Janeys mum is offering her daughter is leading her towards an un-healthy road into womanhood and giving her the belief that the world is like one of her toy dolls, she can pick it up and be responsible when she feels like, or she can throw it away and hide it. Janey is curious about the next stage of her life, wanting to become a ‘woman’. All around her are clues to what this responsibility might entail, but she is left on her own to uncover if her adult role models portray adulthood appropriately. We are shown Janeys view from beside a tree of her mother kissing Cadey, a new family friend. We are then shown Janey witnessing her Mum kissing Cadey again through the bathroom door. Jeffs has deliberat ely positioned the audience to see through Janeys view of the bathroom door. This angle reveals to the audience that Janeys view of adulthood is limited, she is only exposed to the irresponsible actions of her mother, and is therefore copying an un-realistic role model. As viewers we are confused and disgusted that a married woman is being intimate with a family friend who is staying under the same family roof as her husband and two children, especially Janey who witnesses her mother’s actions and believes that being a woman means that drinking and kissing unfamiliar men at parties is normal. â€Å"It’s okay, it’s fun to kiss boys†, this quote , from Janey’s mother is an example of the inappropriate advice Janey is being given. Jeff’s viewers are positioned to see a mother, who leaves her children to their own devices, surrounded by strangers while she devotes her life to drinking and flirting with men at parties and family functions. Janey is influenced by this woman figure in her life, and meaninglessly kisses a boy of her age, before shoving him onto the floor, this is Janey’s perception of intimacy, as she has learnt from her mother and she believes her actions are meaningless and that she is in control of the consequences. The actions of Janey bewilder Jeff’s audience, as we realize that Janey is mimicking her mothers actions, however Janey does not have any true sexual desire and she is unaware of the situations she is leading herself into. Jeff’s audience begin to understand that because Janey had been left un-guided by her parents into her teenage life, she has no true understanding of how her actions will leave her vulnerable and she has no escape. Throughout the film, we are shown Janey’s feeling toward Cadey, a man who has participated in an affair with Janey’s mother, and takes advantage of Janey’s immaturity and inexperience with decision making. Cadey blatantly grooms Janey in front of her mother, making conversation with her which Janey believes she is in control of and feels special. â€Å"Would you like a drink?† Cadey offers Janey alcohol and cigarettes during a family outing on his boat, even though he knows she is only thirteen. Janey’s mu m is dissatisfied within her marriage and unaware that her self-absorption has left her oblivious to Janey’s encounters with Cadey and the obvious signs of his intentions. Later, when Janey ventures into the forest alone with Cadey we are shown a worms eye view shot, the tree height is enhanced, and as viewers we are positioned into Janey’s vulnerable situation. Janey is unaware of just how small she is and the situation she is setting herself up for with this grown man. The next shot of Janey lying in the crucifix position, naked on the forest floor is a worryingly disturbing scene for Jeff’s viewers, and outlines the vulnerability of Janey. Janey’s copycat behaviour of her mother and neglect of parental guidance throughout her stages of curiosity into womanhood from her parents has led her to tragedy. Raised by a poor decision making mother, whose own marital dissatisfaction led her to neglect her children, Janey also has to live with her poor decisions and actions with Cadey, which left her younger brother, Jim to his own devices alone at the beach resulted in him drowning. These consequences have ricocheted from Janey’s parents neglect of their roles and guiders and providers of safety to their children and Janey must now live with the catastrophic loss of her brother and horrifying entrance into womanhood due to her mis-guidance and belief that she, like her mother was in control. Janey’s limited guidance, experience and understanding of the world, left her vulnerable and exposed to predators such as Cadey, who took advantage of her parents neglect and her curiosity. Christine Jeff’s viewers are shown a tragic story of the consequences of poor parenting and decision making, and how our actions influence our younger generation. Through main character Janey, Jeff’s viewers are positioned to recognize the danger Janey and her brother are exposed to and how easy it is for our actions to be witnessed and used as a role model for others and we are left to ponder if our actions could damage the future of others who idolize their elders. Jeff’s audience are shown how through the neglect of guidance and parenting, childrens transitions into adulthood can leave them vulnerable and damaged for the rest of their lives

Week Five Assignment

This type of entity will provide the control of a sole proprietorship while placing liability on the business rather than the individual. Fireworks have the potential to be dangerous, causing serious damage to both people ND property. The potential for liability associated with the use and/or manufacture of fireworks is unavoidable. â€Å"Any one of the following defects may expose the man effectuate to liability for injuries that are caused by their product: design defect, manufacturing defect and defect in marketing,† (McLaughlin, & Laurite, 2014).Liabilities associated with these defects include intentional torts, negligence and strict liability. The first step to avoiding an attack on personal assets is relocating operations to an area zoned for the manufacture of fireworks. No matter what the entity, the manufacture of explosives in a residential area will enable a liability protection to be pierced. An intentional tort will occur when the manufacturer sells a product tha t he knows is defective or dangerous of which injuries are certain to occur. In such cases, ACME has a duty to warn the consumer of potential harm.If ACME fails to provide warnings or recalls on its products, it can be held liable for battery to anyone injured by its products. According to a 1903 product liability case, a company is liable for failing to notify the buyer that the product is potentially dangerous, is effective, or negligence in the manufacture or sale of a dangerous product. See House v. J. I. Case Threshing Mach. Co. , 120 F. 865 (8th Cirri. 1903). Should a mishap occur during the manufacture, sale or storage; a sole proprietor will be liable for any and all property damage incurred to both himself and/or his neighbors. With a sole proprietorship there is no legal distinction between the owner and the business thus, he is at risk of losing personal assets in a lawsuit against the business. Should injury, death, or damage to property occur from intentionally manufactu ring or selling a ungenerous product, both the manufacturer and suppliers can be sued for unintentional injuries. This risk extends beyond the manufacture and supply of the fireworks; it also includes care in design and use. For instance, should a consumer purchase defective ACME Fireworks from a retailer and sustain injury to him and others, ACME can be sued.See Boeing Airplane Co. V. Brown, 291 F. Ad 310 (9th Cirri. 1961). â€Å"Strict liability in tort arises when someone suffers an injury not from anyone's willful negligent act, but rather by engaging in some intrinsically dangerous activity or, under certain resistances, through the manufacturing of unsafe products,† (Rogers, S. 2012). Courts today, rationalize strict liability by establishing the fact that manufacturers are better positioned to prevent risk of loss than, that Of the consumer. As such, it is the responsibility of the manufacturer to ensure their products are safe.In order to be strictly liable for a prod uct, the plaintiff must demonstrate that there is a defect, the defect was caused by the manufacturer and in turn, was the cause of injury. See Kerr v. Corning Glass, 169 N. W.. Ad 587 (Min. 1969). In order to determine Contract Viability, it s important to review the agreements between ACME and the retailers. Examine each contract carefully ensuring it contains five essential elements. The legitimacy of the agreements is dependent upon it containing an offer, acceptance, consideration legality and capacity. To further explain, an offer is an invitation to enter into a contract. If a company agrees to the terms outlined in the offer, they have then accepted the agreement. Once an agreement has been recognized, it must be established that both parties have intentions to enter into a legal binding contract. The considerations of his agreement are legal exchanges for services or products. For ACME Fireworks, this will include the prices paid for the fireworks and the amounts desired. In order to be legally binding, the cost of doing business must not be illegal and, the ability to perform must not be impossible. Finally, it must be determined that both parties have entered into the contract freely without coercion or duress. Additionally, the law prohibits contracts made with persons of diminished mental capacity and minors. The contract probability concerns itself with the performance specifications and acquirement of the agreement. Though the agreement appears to be viable, if it lacks a specific performance strategy, it will not have a future. The probability Of the agreement to remain in force will be dependent upon the period of performance and quantities desired during that period.Fireworks are seasonal whereby; a retailer agreeing to order large quantities on a regular basis is not realistic. There is no guarantee the quantities will remain consistent throughout the contract period. Additionally, ACME is concerned about failing to meet its contractual obliga tions should it not hire enough people. The basic questions that need to be addressed are: how and when to order, amounts to order and what happens if ACME fails to deliver? The owner is concerned that there will not be enough work for the additional employees once the initial orders have been filled. The terms and conditions of the contract will determine the type of employees ACME will hire. At-will employment provides no obligation of continuous employment once the orders have been filled. For this reason, the law allows an employer to terminate without just cause or reason. Generally, this rule is applied for seasonal work. ACME Fireworks has several options to consider in meeting contract demands, performance and productivity. By hiring temporary full-time associates, ACME can readily meet demands however; there is no incentive to maintain a standard of quality or productivity.Same is true for part-time associates as their hours are usually dictated by the needs or demands Of a business. Consideration for casual and day labor employees might prove useful. Casual employees typically work on an as needed basis and usually consist of single parents, college students or applicants seeking extra money. Temp Agencies provide labor on a daily, weekly or monthly basis. Typically, temp agency employees that excel are offered permanent positions within an organization. Hiring regular employees on a probationary basis will allow ACME the ability to meet the quality, performance and productivity of the contract.Generally a just-cause type of employment this employee is evaluated at the end of a specified period based upon certain criteria. If an employee fails to meet standards then they are usually let go. With the increase in business size and operation certain liabilities can raise concern. It is important to understand the differences associated with the different entities when choosing what best fits your organization. Whether choosing a Sole Proprietorship, a Pa rtnership, a Corporation or a Limited Liability Company, it is important to assess all the risks associated with the nature of the business.Currently, ACME Fireworks operates out of a garage and the owner enjoys complete autonomy over operations. Operating as a Sole Proprietorship, the business and the owner remain one and the same. This provides the highest risk of loss to personal assets. The disadvantage is that a sole proprietor has limited options for raising capital and no limits on liability for business debts; thus if the business does not fare well, the sole proprietor can face personal bankruptcy,† (Rogers, S. 2012).As a partnership, ACME Fireworks will share ownership with two or more people. â€Å"Partners are automatically owners and managers of the business, and the law presumes equal rights unless the partners have specified otherwise,† (Rogers, S. 2012). In a partnership, taxes are assessed on the earnings of the partners and not that of the business. Sh ould the company become party too lawsuit or is unable to fulfill its contractual obligations, the personal assets of all the partners can be used to satisfy a judgment by the court. Partners are not only liable for their own actions, but also for the business debts and decisions made by other partners. In addition, the personal assets of all partners can be used to satisfy the partnership's debt,† (SABA. Gob, 2014). Should ACME Fireworks consider a Corporation, it will become an independent legal entity. The owner(s) will then become shareholders which will limit their liability and legal responsibility. In order to remain free of any personal liability, the company must operate according to state corporation laws. If the corporate form of business organization is used to defraud creditors, stockholders will lose the protection of limited liability and will be held personally liable for all debts of the corporation,† (Rogers, S. 2012). Since a corporation requires the f iling of complicated forms, annual reports and fees, it can prove costly for a small company. Additionally, a corporation is double taxed whereby; the company pays taxes on its earnings and the shareholders pays taxes on dividends paid UT. A Limited Liability Company (LLC) provides the limited liability features of a Corporation but operates like a partnership or sole proprietorship.A LLC â€Å"typically features easier formation (although filing under the statute is required) and lower filing fees, flow-through taxation where members of a LLC are taxed on their earnings, but the business itself is not taxed, the stability of a corporation (a member's leaving will not dissolve the LLC), and limited liability, where the business is liable for its debts and the people who own it are not,† (Rogers, S. 2012). Since ACME Fireworks is a small business with a single owner, a LLC will provide a low cost alternative that provides limited protection of personal assets.Unlike like a cor poration, the taxes, profits and losses are passed through to each member of the LLC. Members are protected from personal liability for the actions and decisions Of the LLC. However, in the case of wrongful or illegal acts, the limited liability can be pierced and personal assets can be assessed. Additionally, it is important to separate business funds from personal funds. Should ACME use a personal ann. account to pay its creditors, they can in turn pierce the limited liability and seize the owners' personal funds. The Federal Government does not recognize a LLC as a separate entity as in a corporation. As such, the owner(s) of ACME Fireworks will file their shared earnings on their personal income tax. If the LLC is a single owner operation, income will be reported on a Schedule C just like that of a sole proprietorship. Should there be more than one member sharing in the profits and losses, a form 1 065 will be filed as is done in a Partnership. The entire net income of the LLC mu st be accounted or in the filings of all members involved. The owner of ACME Fireworks has asked for advices in choosing an entity that would provide the least risk to personal assets, should he fail to meet his contractual obligations. It is important for ACME Fireworks to understand the risks associated with the nature of the business. In assessing the current operation, ACME Fireworks operates out of a garage and currently employs approximately 15 people. The liabilities associated with the manufacture of dangerous materials poses a high risk to personal assets should a mishap occur. Before engaging rather, ACME must consider relocating to meet both local and state zoning laws. Additionally, Federal OSHA standards must be in place in order to release the owner of allegations associated with safety, wrong doing, or negligence. The law provides certain protections associated with All's and Corporations. As a sole-proprietor, ACME Fireworks and the owner are one in the same. Should th e company fail in its obligations or fail to warn and/or injure a consumer, the owner is held personally liable. If ACME is to pursue a partnership, the partners share in the personal liabilities of the company. For he production of what is considered dangerous materials (fireworks), the risks associated with injuries from product liability to manufacture are substantial. The company IS liable for intentional torts, negligence and strict liability as such; neither a sole-proprietorship nor partnership is suggested. As a manager of ACME Fireworks, would recommend the company pursue a Limited Liability Corporation. According to the Small Business Administration, â€Å"Members are protected from personal liability for business decisions or actions of the LLC,† (SABA. Gob, 2014). Essentially, if the LLC becomes party to a suit or is unable to fulfill its obligations, members enjoy the same protections as that of shareholders in a corporation. However, as a limited liability company , they are not exempt from litigation involving wrongful acts by its members or employees. In a LLC, the owner will retain control over the company as in a sole-proprietorship and lessens the risk of personal liability. The owner is also concerned with ACME's ability to meet either contractual obligations or make payroll. The LLC would provide the protections it needs without relinquishing control to a Board of Directors, as in a corporation. Without knowing the specific terms and conditions of the agreements, it is difficult to ascertain viability and validity.

Challenges and Best Practices in Corporate Governance

Former Finance Secretary Jesus Estanislao once compared good corporate governance as keeping one’s house in order. Most people want well-run households, one that keeps a lid on expenses while keeping things neat and clean and takes care of the various needs of family members. In the business setting, a clean house is more attractive to prospective investors. Good corporate governance promotes transparency, accountability and responsibility. Corporate governance is not just about ethical conduct or being transparent and fair to stakeholders, it is also a means to improve a company’s performance, competitiveness and sustainability. In the Philippines, compliance with corporate governance codes is still relatively low. It is probably an offshoot of the way most Asian economies do business, which is largely personal and based on connections—whether by family, affinity or friends. In addition, the adoption of good corporate governance practices is a function of a firm’s financial performance. In Singapore for example, a relatively developed economy, a recent report showed a widening gap between companies with strong and weak corporate governance policies. But it is when crisis occurs when the defects in corporate governance are seen. Learning curves for the adoption of scorecards and best practices for corporate governance are a tad high, and maybe difficult for several companies to implement. Dr. Estanislao once said that his advocacy for companies in the Philippines to adopt good corporate governance standards is a slow burn. But someone has to do it, and progress must start as soon as possible so it can also blossom faster.

Apple a Day

An Apple a Day Keeps the Doctor Away Eating Healthy and exercise are essential to the health and well-being of all people. A healthy diet along with exercise can help you live longer, feel better about better food choices; provide you with more energy, help you stay at a healthy weight, and help you fight stress. Do you want to live longer and be healthier? Then make that first step and maximize the benefits from being active and eating healthier. It is important to make sure and eat fruits and vegetables daily, at least 5 servings. The best way to be healthier is to incorporate into your daily routine eating fresh fruits and vegetables such as: apples, bananas, strawberries, pineapple, blueberries, grapes, carrots, potatoes, peas, and broccoli. This list can go on and on and you will find there are plenty of fruit and vegetables that you will enjoy. â€Å"Vegetables and fruits are clearly an important part of a good diet. Almost everyone can benefit from eating more of them, but var iety is as important as quantity. No single fruit or vegetable provides all of the nutrients you need to be healthy. The key lies in the variety of different vegetables and fruits that you eat† (Willet, 2007, Harvard School of Public Health). Doctors and nutritionists highly promote fruits and vegetables because they offer many benefits to being healthy. They are excellent sources of essential nutrients, such as vitamins and anti-oxidants. People who eat diets rich in fruits and vegetables have a decreased risk of several chronic diseases, including cardiovascular disease, high blood pressure and diabetes. As the saying goes, â€Å"an apple a day keeps the doctor away. A healthy eating plan will protect against many health problems and improve the way our body functions. Annabel Bentley, BUPA assistant medical director, has this advice: â€Å"As one of the leading independent health and care providers in the country, BUPA is pleased to support this campaign. A balanced diet i s one of the best ways to maintain good health and help prevent the onset of some serious diseases. Eating well need not be expensive or complicated and this new campaign is geared to leading people towards the right things to eat. † Eating healthy can help in living a longer and healthier life.It can also strengthen your immune system, which can help in fewer sicknesses. The benefits from eating healthy go on and on and will improve your lifestyle dramatically. Proper eating can even help some have healthy lush looking hair, skin and nails and everyone wants to have beautiful skin, hair and nails. Eating healthy can help in feeling better within oneself. A healthy diet along with exercise will provide the body with more energy and make you feel better about yourself and can help fight stress and depression. Eating unhealthy can cause many health problems.Besides obesity and diabetes, there is high blood pressure, heart problems, breathing difficulty, anemia, and joint problem s all due to extra weight. Healthy eating can help protect people from cancer, heart attacks, diabetes and problems with blood pressure. Blood pressure is the force that pushes the blood from the heart through the arteries in the body. High blood pressure becomes dangerous because is makes the heart work too hard. Even when the pressure is only slightly raised for a long period of time it can damage arteries and cause organ damage.I personally have high blood pressure and the doctors are constantly advising me to eat better, exercise and lose weight and when I apply their council my blood pressure does improve dramatically. † High blood pressure is a primary risk factor for heart disease and stroke. As such, it is a condition that is important to control. Diet can be a very effective tool for lowering blood pressure. One of the most convincing associations between diet and blood pressure was found in the Dietary Approaches to Stop Hypertension (DASH) study. This trial examined the effect on blood pressure of a diet that was rich in fruits, vegetables, and low-fat dairy products and that restricted the amount of saturated and total fat. The researchers found that people with high blood pressure who followed this diet reduced their systolic blood pressure (the upper number of a blood pressure reading) by about 11 mm Hg and their diastolic blood pressure (the lower number) by almost 6 mm Hg—as much as medications can achieve† (Appel, Moore, Obarzanek,1997, clinical trial).By making sure to eat a balanced diet then the occasional fatty food or takeaway will not hurt, but it will become a problem if you eat fatty foods everyday. It can be easy to fall into the trap of eating takeaway food every night because most people have busy hectic lives and find that they do not have the time or energy to cook something healthy. â€Å"Junk food has become a pillar in modern society. It offers a quick fill, fast service, or you can bring it home to watch a m ovie with. From chips, pop, ice cream it goes on and on.There is no nutritional value in any of it. Even the canned produce should be considered junk food. Preservatives are jamming the tops of these containers of fruits in order for them to remain edible for months and months† (Healthy Eating, 2008, Health benefits of food). While it would be nice to take a pill and wake up 15 lbs lighter, the truth is that weight loss takes time and effort as well as a commitment to eating healthy everyday. The best way to begin to reduce the amount of weight people put on would be to reduce any un-necessary fat intake.Fat intake can be difficult to manage because fat makes food taste so much better. It is so tempting to grab a donut or candy bar when craving a snack, but it can be just as easy to grab an apple or a bag of carrots and your body and your health will reap better benefits from it. â€Å"Most people who work at eating better know that the salad bar can be a terrific way to eat out, eat great food and have a healthy meal. There are a few items that can tip the scales as far as fat and calories are concerned, especially if you are trying to watch your weight.A major offender is salad dressings. † Doctor Gourmet, (2008). Weight is such a sensitive subject for many people, young and old , which is why it+ does need to be addressed, because people today especially children are becoming obese at alarming rates. Many people think that it is just too difficult to eat healthy, or they do not know what to eat. â€Å"What you should eat is actually pretty simple. But you would not know that from news reports on diet studies, whose sole purpose seems to be to confuse people on a daily basis. When it comes down to it, though—when all the evidence is looked at together—the best advice on what to eat is relatively straightforward: Eat a plant-based diet rich in fruits, vegetables, and whole grains; choose healthy fats, like olive and canola oil; and red meat and unhealthy fats, like saturated and trans fats, sparingly. Most important of all is keeping calories in check, so you can avoid weight gain, which makes exercise a key partner to a healthy diet† (Willet, 2007, Harvard School of Public Health) As for keeping the weight off, avoid the elevator and take the stairs. If you take the stairs regularly, you will burn more calories. As you do it more often, you will learn that you have more energy. In order to be healthy, we need to learn what it means to eat healthy and to live healthy. The first step is making sure to eat plenty of fruits and vegetables on a daily basis and avoid unnecessary fats in our diet. The best way to avoid fats is by not eating fast food or junk food on a regular basis. Exercise needs to be a top riority in our lives to keep stress away and to feel energized, even if it is as simple as a walk in the park. When it comes to diet and exercise, you have to ask yourself a very important question. How mu ch do you care about yourself? It is up to all of us to make a commitment to set aside a little time each day for exercise. As far as eating healthy is concerned, just focus on each individual day. Do not go to the extreme, because this is setting you up for failure. Just make small changes throughout the day.At night, simply walk away from that huge slice of chocolate cake. It is all up to you to live a healthy lifestyle. Discipline, control and focus can be hard to maintain when it comes to eating healthy and exercising regularly. It can be hard, especially in the beginning, but it is essential that you be consistent. By being consistent it will get easier and easier to make necessary lifestyle changes. By making these positive lifestyle changes in your life it will go a long way in living a long healthy life for years to come.
